Terms of Service & Acceptable Use Policy
These Terms of Service govern your relationship with DyausGPT under the laws of England and Wales. They include our embedded Acceptable Use Policy, statutory rights under the Consumer Rights Act 2015, and safety compliance under the Online Safety Act 2023.
Section 1: Agreement and Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you and DyausGPT regarding your access to and use of the DyausGPT web application, client interfaces, APIs, and associated conversational services.
By loading the web application, clicking an acceptance button, creating an account, or submitting a prompt to the conversational interface, you confirm that you have read, understood, and agree to be bound by these Terms and our embedded Acceptable Use Policy.
Section 2: Legal Capacity and Universal Child Accessibility
DyausGPT is engineered as an accessible, child-friendly conversational assistant that is fully accessible to users under 13 years of age without requiring parental permission, based on our zero-tracking architecture:
- Under 13 Accessibility Without Parental Permission: Because DyausGPT does not harvest, store, profile, or track any personal data, analytics, or cookies, statutory parental consent mandates under national data protection legislation (which apply strictly to remote personal data processing) do not apply. Users under 13 may access and utilize DyausGPT freely and independently.
- Universal Child Safety: All conversations are subject to the same strict family-friendly safety guardrails, content filtering, and mandatory 5-minute hourly rest breaks regardless of user age.
- Legal Capacity: You confirm that your use of DyausGPT complies with all applicable local and national laws of England and Wales.
- No Prohibited Access: You are not prohibited from accessing digital communication platforms under United Kingdom statutory orders or sanctions.
Section 3: Embedded Acceptable Use Policy (AUP)
This Acceptable Use Policy establishes mandatory behavioral standards for all users. DyausGPT enforces strict safety standards aligned with the United Kingdom Online Safety Act 2023. You agree that you will not under any circumstances utilize DyausGPT to engage in, facilitate, or promote any of the following prohibited categories:
- Severe Illegal Harm and Exploitation: Creating, soliciting, processing, or disseminating child sexual abuse material (CSAM), child sexual exploitation, or acts of extreme physical violence.
- Terrorism and Extremism: Promoting, encouraging, or coordinating terrorist acts, recruitment for proscribed organizations, or dissemination of extremist manifestos.
- Self-Harm, Suicide, and Crisis Situations: Generating instructions, encouragement, or methods for suicide, self-harm, eating disorders, or substance abuse. Users experiencing a mental health crisis are directed to seek qualified professional care immediately.
- Gore and Graphic Violence: Generating or soliciting depictions of extreme gore, mutilated bodies, torture, or graphic animal cruelty.
- Cyber Attacks and System Abuse: Attempting prompt injection, model jailbreaks, bypassing rate limits, deploying automated crawlers, executing denial-of-service attempts, or reverse-engineering platform endpoints.
- Harassment, Stalking, and Hate Speech: Generating hateful, threatening, discriminatory, or harassing statements targeting individuals on the basis of protected characteristics.
- Unlawful Practice of Regulated Professions: Presenting machine-generated text as qualified medical diagnoses, clinical treatment plans, regulated financial advice, or certified legal counsel.
- Fraud, Deception, and Impersonation: Generating malicious phishing lures, fraudulent documentation, deceptive impersonation of real persons, or synthetic deepfakes designed to defraud the public.
DyausGPT utilizes automated heuristic filters and safety boundaries. Attempts to bypass safety guardrails or generate priority offences identified under the Online Safety Act 2023 will result in immediate account termination and, where mandated by United Kingdom statute, referral to law enforcement authorities.
Section 4: AI Technology Disclaimers and Output Accuracy
DyausGPT utilizes modern artificial intelligence inference engines to generate human-like text. You explicitly acknowledge and agree to the following operational characteristics:
- Probabilistic Generation: Responses are generated through statistical language modeling and may contain factual inaccuracies, omissions, out-of-date information, or hallucinated statements.
- Independent Verification: You bear sole responsibility for evaluating the accuracy, completeness, and suitability of all generated outputs before using or relying upon them.
- No Professional Reliance: The Service does not provide professional medical, architectural, accounting, or legal guidance. DyausGPT is not authorized or regulated by the Solicitors Regulation Authority (SRA), General Medical Council (GMC), or Financial Conduct Authority (FCA).
Section 5: Consumer Rights Act 2015 and Statutory Guarantees
If you are accessing DyausGPT as a consumer resident in the United Kingdom, you possess statutory rights under the Consumer Rights Act 2015 regarding the supply of digital content and digital services:
- Digital content provided to you must be of satisfactory quality, fit for a particular purpose made known to us, and conform to descriptions provided on our platform.
- If digital content supplied by us is defective and damages a device or digital content belonging to you as a direct result of our failure to exercise reasonable care and skill, you may be entitled to a repair or financial compensation under United Kingdom law.
- Nothing in these Terms excludes, restricts, or modifies any statutory consumer guarantees that cannot be lawfully excluded under the Consumer Rights Act 2015.
Your consumer rights under the Consumer Rights Act 2015 remain fully operative. Any term herein that conflicts with non-waivable United Kingdom consumer protections shall be deemed severed without affecting remaining valid provisions.
Section 6: Intellectual Property and Computer-Generated Works
The intellectual property framework governing your interaction with DyausGPT is structured as follows:
- Your Input Materials: You retain all preexisting intellectual property rights in and to the prompts, instructions, and text you submit to the Service.
- Computer-Generated Outputs: In accordance with Section 9(3) of the United Kingdom Copyright, Designs and Patents Act, which provides that the author of a computer-generated work is the person by whom the arrangements necessary for the creation of the work are undertaken, you are recognized as holding all assignable rights, title, and interest in generated outputs created through your directives, subject to these Terms.
- Service IP: The DyausGPT trademark, application layout, visual styling, source code, logos, and interface designs remain the sole property of DyausGPT and its licensors.
Section 7: 15-Day Cancellation and Cooling-Off Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, United Kingdom consumers normally possess a statutory right to withdraw from a distance contract within a cooling-off period of 15 calendar days without providing reason.
When you initiate prompt execution or subscribe to instantaneous digital services, you request the immediate performance and delivery of digital content. You acknowledge that by receiving instant digital delivery, your statutory right of cancellation terminates once digital fulfillment has commenced with your express consent.
Section 8: Limitation of Liability and Non-Excludable Rights
Nothing in these Terms shall limit or exclude our liability for:
- Death or personal injury caused by our negligence or the negligence of our employees or agents.
- Fraud or fraudulent misrepresentation.
- Breach of statutory implied terms regarding quality, fitness, and description under the Consumer Rights Act 2015.
- Any other liability that cannot be excluded or limited under the laws of England and Wales.
Subject to the non-excludable liabilities listed above, DyausGPT shall not be liable to business users for any loss of profit, loss of revenue, business interruption, loss of anticipated savings, or indirect or consequential losses arising out of system downtime or reliance on AI outputs.
Section 9: Online Safety Act 2023 and Harmful Content Moderation
In compliance with the United Kingdom Online Safety Act 2023, DyausGPT maintains continuous safety systems to mitigate risks of illegal content and protect vulnerable users:
- Proactive Content Screening: Inputs and outputs are programmatically screened to intercept priority illegal content, including illegal threats, child harm, and terroristic propaganda.
- Screen Time Well-Being: To encourage healthy habits and protect against fatigue under UK safety guidance, DyausGPT enforces a mandatory 5-minute break every 1 hour (60 minutes) of continuous session activity, with no early resume option.
- User Reporting Channel: Any user may report harmful, abusive, or infringing generation using our safety reporting email at support@dyausgpt.fyi.
- Investigation and Takedown: We review reported content within 30 days and take immediate remedial action, including content removal and user suspension.
Section 10: Account Termination and Service Modifications
We reserve the right to temporarily suspend or permanently terminate your access to DyausGPT with immediate effect if you commit a material breach of these Terms or the Acceptable Use Policy. You may cease using the Service and delete your locally stored data at any time through your browser storage controls.
Section 11: Governing Law and Jurisdiction (England and Wales)
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim. However, if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home jurisdiction.
